WHEN YOU CAN APPLY FOR LICENCE RESTORATION
In certain circumstances, you can apply to have your licence back before the end of a disqualification period.
If you were disqualified for 4 years or less, then you must have served at least 2 years of your disqualification before making your application.
If you were disqualified for between 4 and 10 years then you must have served at least half of your disqualification before making your application.
In any other case you must have served 5 years of your disqualification.
An application cannot be made if the disqualifying court ordered a “retest” to be completed.
REASONS A COURT WILL CONSIDER
An application is most likely to succeed if you can show the court that your circumstances/character has changed since the time of your conviction.
The court will consider:
• Your character and conduct following conviction;
• The nature of the offence for which disqualification was ordered; and
• Any other relevant circumstances (E.g. Employment status, family/personal circumstances)
Applications are likely to be opposed by the police and it is crucial that you are represented if the application for removal of disqualification is to be successful.
